General Terms and Conditions
for the rental of holiday apartments at Säuling x Ludwig, Achweg 12, D-87645 Schwangau
Section 1 Scope
These General Terms and Conditions apply to all contracts for the rental use of holiday apartments at Säuling x Ludwig for accommodation and to all further services and deliveries provided in this context. Subletting or re-renting the apartment provided, as well as using it for purposes other than residential purposes, requires the prior written consent of the landlord.
Section 2 Booking / conclusion of contract
By making a booking, the tenant makes a binding offer to conclude a rental agreement. The contract is concluded with the written booking confirmation by the landlord. The tenant is bound to the booking for up to 10 days after sending the booking request.
Section 3 Payment
Upon conclusion of the contract, a deposit of 36% of the total rental price is due, payable within 14 days after receipt of the booking confirmation. The remaining payment of 64% of the total rental price is due no later than 7 days before arrival.
Section 4 Arrival and departure
The holiday apartment is available to the tenant from 4:00 pm on the day of arrival. On the day of departure, the apartment must be vacated by 11:00 am and handed over swept clean. Key handover takes place by arrangement.
Section 5 Stay
The tenant undertakes to treat the holiday apartment with care. Quiet hours from 10:00 pm to 7:00 am must be observed. The maximum occupancy of the apartment may not exceed the number of persons agreed in the rental agreement.
Section 6 Condition of the apartment
The holiday apartment is handed over in proper, clean condition. The tenant is obliged to notify the landlord immediately of any visible defects. Claims are excluded if defects are not reported in due time.
Section 7 Pets
Pets are not permitted in the holiday apartments.
Section 8 Cancellation by the tenant
If the tenant cancels, the following scale applies:
- Up to 30 days before arrival: 36% of the total rental price
- Up to 7 days before arrival: 75% of the total rental price
- Less than 7 days before arrival: 95% of the total rental price
We recommend taking out travel cancellation insurance.
Section 9 Withdrawal by the landlord
The landlord may withdraw from the contract if the deposit is not received on time or if force majeure or other circumstances for which the landlord is not responsible make fulfillment of the contract impossible. In these cases, payments already made will be refunded.
Section 10 Liability
The landlord is not liable for the loss of or damage to items brought into the apartment. Use of the sauna, whirlpool and other facilities is at the tenant’s own risk. Claims for damages by the tenant are excluded - regardless of the legal grounds - unless the landlord is guilty of intent or gross negligence.
Section 11 Wi-Fi
The landlord provides free Wi-Fi. No guarantee is given for availability or speed. The tenant undertakes not to use the Wi-Fi for unlawful purposes.
Section 12 Written form
Changes and additions to the contract must be made in writing. This also applies to the waiver of the written form requirement.
Section 13 Severability clause
If any provision of these Terms and Conditions is or becomes invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by the valid provision that comes closest to the economic purpose of the invalid provision.
